CABA 2017 Student Essay Competition
Offered by: Canadian American Bar Association
Value: $500.00 USD 500
Deadline: check weblink for yearly deadline and updates 20170531
Description:
CABA is proud to announce the 2017 edition of its annual student essay competition. This competition is an integral part of CABA's mission to provide a voice to Canadians in the United States and Americans in Canada and to foster a greater understanding of rules with cross-border implications as well as an engagement in their development.
Admissibility
Any student registered in a Canadian or American law school for the Winter and/or Spring semesters of 2017 (whether in the J.D., LL.B., B.C.L. or equivalent first degree program, or in the LL.M. program). However, students completing doctoral or postdoctoral studies are not admissible.
In addition, based on this year's essay theme, students registered in undergraduate or master's degree programs which have a mandatory international law component are also admissible.
Theme
Since the North Agreement Free Trade Agreement ("NAFTA"), a regional agreement between Canada, the United States and Mexico to implement a free trade area, entered into force on January 1, 1994, the two-way trade between Canada and the United States has more than tripled, reaching some $2.4 billion in goods and services daily over the course of 2015. Canada is now the top export destination for 35 American states, while the United States is the most important destination for Canada's direct investments abroad.
Despite this increasing level of economic interdependency and trade, during his campaign for the American presidential election, Donald Trump qualified NAFTA as the "worst deal ever made" and vowed to withdraw from the agreement if he cannot achieve a satisfactory renegotiation of the treaty. In the days following the election, Canadian Prime Minister Justin Trudeau declared that he was "happy to talk" about renegotiating NAFTA. A memo from Mr. Trump's transition team obtained by the media indicates that the next American president intends to follow through on the renegotiation of NAFTA, and more particularly with regards to Canada, intends to target the rules currently regulating livestock and softwood lumber.
Since it is likely that renegotiation over NAFTA will commence in 2016, we invite students to write essays identifying one issue which in their opinions should be part of the renegotiation of the agreement between Canada and the United States. The essays should explain why the issue is in need of renegotiation, how it affects both countries, and how a renegotiated agreement should address the issue and why.
Rules
The essays should be drafted in English or French, submitted in both Word and PDF formats, and have no more than 3500 words, including the title and the footnotes. It should be submitted no later than May 31, 2017 via email at policyandadvocacy@canambar.
com . In the cover email, the student should include the following information: (a) full name; (b) city of origin; (c) school; (d) program; (e) year level; (f) address; and (g) phone number. The winner of the essay will be announced on or before July 31, 2017.

The Blackburns
Lucie and Thornton Blackburn founded the first taxi company in Toronto in the 1830s. Their successful business enterprise was all the more notable in that the Blackburns were also involved in a number of other "firsts". The Blackburns' inspiring story included sparking the first racial uprising in Detroit history and the first serious legal dispute between Canada and the United Sates regarding the Underground Railroad.
In 1831 Lucie and Thornton Blackburn made a daring escape from slave markets in Louisville, Kentucky. They fled north only to be discovered by slave catchers in Michigan, and were destined to be returned to slavery in Kentucky until the local black community in Detroit rallied to their cause sparking the Blackburn Riots of 1833.
Escaping custody, the couple fled to freedom in Canada. In June 1833, Michigan's governor demanded their extradition. An impassioned and successful defence of the Blackburns by Upper Canada's Lieutenant Governor set precedent for future fugitive slave cases in Canada.
The tale of the Blackburns was lost to history until a chance archaeological discovery in a downtown Toronto school yard again brought the story of Lucie and Thornton Blackburn to light. Their story is recorded in "I've Got A Home In Glory Land", a Governor General's Award winning book written by Karolyn Smardz Frost. As noted in the book, Fasken Martineau acted as legal counsel to the Blackburns.

IADC Legal Writing Contest
Offered by: IADC International Association of Defense Counsel
Value: 1st place $2,000.00 US
2nd place $1,000.00 US
3rd place $500.00 US
Honorable mention placque 2000Deadline: check weblink for yearly deadline and updates 20170519
Description:
All J.D. candidates currently enrolled in accredited law schools are eligible to participate in the IADC Legal Writing Contest. Entrants must write on subjects in the fields of tort law, insurance law, civil procedure, evidence or other areas of the law of practical concern to lawyers engaged in the defense, or management of the defense of civil litigation. The contest is judged by a committee of the IADC.
Winning and honorable mention entries are considered for publication in the IADC's quarterly academic publication, the Defense Counsel Journal. The judges also may award honorable mentions.
Past experience has shown that teachers of litigation-related subjects are in an ideal position to stimulate student interest in legal writing and to encourage participation in the IADC Legal Writing Contest. Each year a number of the entries appear to have been prepared initially for various courses or seminars, and the caliber of the papers has been high. These faculty members are in an excellent position to encourage their students to enter the IADC contest.
Deans, professors, and law review editors are urged to publicize the IADC contest and to encourage participation in it.
Contest Rules
-
Eligibility. The International Association of Defense Counsel 2017 Legal Writing Contest is open to students who, at the time of submission of their entries, are enrolled as J.D. candidates in accredited law schools.
-
Subject Matter. Entries must be submitted in the English language on a subject of practical concern to lawyers engaged in the defense or management of the defense of civil litigation, such as relevant aspects of tort law, insurance law, civil procedure, evidence, damages, alternative dispute resolution procedures, and professional ethics.
-
Authorship and Publication. Entries must be certified by the entrant on the IADC entry form to be the original and sole work of the entrant. At the time of submission, the entry must not have been published or accepted for publication, and the author must be free to execute the assignment of copyright to IADC referred to in Rule 7.
-
Judging. The contest will be judged by a committee of the IADC, whose decisions will be final. In addition to the monetary award winners, the judges may designate entries worthy of honorable mention.
-
Judging Standards. Articles will be judged on the following factors: (1) the choice of subject matter, as measured by its significance, international or national relevance, and timeliness; (2) the amount of work and effort, as measured by the entry's comprehensiveness and analysis; (3) the 5. quality of the legal analysis, as measured by its objectivity and balance; and (4) the writing quality, as measured by clarity of expression, brevity, and literary construction. Entrants also should consider the points made in the contest guidelines.
-
Monetary Awards. Monetary awards will be made as follows: US $2,000 to the first place winner, US $1,000 to the second place winner, and US $500 to the third place winner. Honorary mentions receive no monetary awards.
-
Plaques and Publication. Authors of monetary award articles and of those awarded honorable mention will receive commemorative plaques, and their articles will be made available for publication in Defense Counsel Journal, IADC's quarterly law review. At the time of submission, entrants must execute the assignment of copyright in the entry certificate. IADC will copyright articles published in Defense Counsel Journal, but release the copyright assignment back to entrants whose works are not published. Acceptance for publication in any publication other than Defense Counsel Journal prior to notice to the author of an award in this contest will disqualify the entry. Entrants are expected to notify IADC promptly of such prior acceptance by another publication.
-
Directions for Transmission. Entries, together with the completed entry form, must be sent to the International Association of Defense Counsel, via electronic mail to Melisa Maisel Vanis at mmaisel@iadclaw.org.
Contest Guidelines
-
Substance
-
Choice of Subject. Rule 2 allows for a broad range of topics, provided it is one of practical concern to lawyers engaged in the defense or management of the defense of civil litigation. Unusual subjects are desirable if of sufficiently widespread interest beyond the borders of any state or province.
-
Balance. Entries should be of law review type and quality, not briefs. Authors' opinions should reflect consideration of both sides of the issues.
-
Original Work. Compliance with this requirement of Rule 2 permits borrowing from the writings of others, provided due attribution is given. An article must not parallel its sources too closely in form or content, and direct quotations must always be shown as such.
-
Sole Authorship. Entries must be the work of a single author. An entry does not fail the "single author" test merely because it has been graded by a professor who has offered advice on it. Sole authorship cannot be claimed, however, if, for example, a paper has been rewritten in part by another person, or if another has contributed research to the paper.
-
Legal Analysis. A major factor is the quality of legal analysis reflected by an article. Clear thinking and expression are key faculties of a good lawyer. While lawyers and judges alike are seldom capable of resolving questions of law solely by the cool light of reason, unclouded by predilections or prejudices, they must justify their conclusions with sound reasoning and pertinent authorities.
-
-
Form
-
Organization. Any well-written article must be organized and presented in a logical and orderly manner. This is best accomplished by initial preparation of an outline that (1) disciplines the author's thought processes; (2) provides a table of contents; (3) supplies headings for quick reference; and (4) eliminates the need for lengthy introductions and conclusions.
-
Hallmarks of Fine Writing. The three hallmarks of fine legal writing are simplicity, clarity, and brevity.
-
Simplicity. A simple writing style befits legal writing because it is easily understood and does not overtax the reader's powers of concentration. Just as long sentences, laden with dependent clauses, should be avoided, so, too, lengthy paragraphs should be avoided.
-
Clarity. Yale Professor John Berdan used to tell his English composition class that a fine writing is like a windowpane: seen through, but never seen.
-
Brevity. While the IADC Legal Writing Contest imposes no strict word limitation, brevity is to be desired, although it is a mixed virtue. A well-written law entry should include all points necessary to full treatment of the subject. Past experience has shown that most entries are unnecessarily prolix and repetitious. Trim off the fat; leave the bone and sinew.(Suggested word limit: 12,000 words, including footnotes)
-
-
-
Miscellany
-
Entries must be submitted via email in English in Microsoft Word format to Melisa Maisel Vanis at mmaisel@iadclaw.org. Footnotes should appear on the page referenced in the text. Avoid excessive footnotes. Use The Bluebook: A Uniform System of Citation (19th edition) for style.
-
-
Cicero's Advice
-
The winning entries will be those that best heed the 2,000-year-old advice of the Roman orator, Marcus Tullius Cicero: "Be clear, so the audience will understand. Be interesting, so the audience will listen. Be persuasive, so the audience will agree."

2017 Three Part Essay Question
Frank was driving his vehicle at night on an unlit winding road when, without slowing his vehicle, struck a man who was running on the shoulder of the road adjacent to a baseball field.
The posted speed limit for the road was 50 miles per hour.
The officer arrived at the scene of the accident 15 minutes later and found Frank sitting in his car in the field. Without giving Frank any Miranda warnings, the officer asked him why his car was in the field, and Frank said that he was driving down the road and his car hit "something." The officer noticed that Frank's eyes were glassy, his speech was slurred, and his breath had a strong odor of alcohol. When Frank exited the car at the officer's direction, he could not stand without holding onto the car. Frank refused the officer's request that he take a breath test to determine the percentage of alcohol in his blood. An ambulance arrived, and the pedestrian was pronounced dead.
The officer arrested Frank and took him to the police station. The officer then appeared before a judge who, based upon the above facts, issued an order for a chemical test of Frank's blood. The blood test was administered and showed Frank's blood alcohol level to be substantially above the legal limit for driving while intoxicated.
Frank was indicted for the crime of manslaughter in the second degree.
- Does Frank have the right to have the results of the blood test suppressed? Explain.
- Does Frank have the right to have his statement suppressed? Explain.
- Was the evidence presented at trial legally sufficient to support a conviction of manslaughter in the second degree? Explain.
Tips for the Essay
- Research the questions and subject carefully. Laws vary depending upon what state an offense occurs in. Learning different State's laws can help you to comprehend the reasoning behind those differences. This is your personal analysis, not an assignment in which you copy and paste a set of laws that already exist.
- Make sure to be original. Do not just repeat something you read elsewhere. Do not plagiarize. You will be immediately disqualified.
- Many of those who participate may feel emotionally affected by the question. Feel free to share your personal perspective. It will be judged objectively and without regard to whether it is "right" or "wrong".

We want to encourage students to take an interest in tort law, to better understand how it affects society, and to consider a career in personal injury law - that is why we are offering this scholarship.
The Litwiniuk & Company Personal Injury Law Scholarship is an annual scholarship in the amount of $5,000 for the best essay on tort law, as judged by our lawyers. The scholarship is open to students currently studying at or admitted to any Canadian or American law school.

Description:
The Law School Admission Council's Diversity Committee Announces a Writing Competition on:
Why pipeline programs targeting students from underrepresented racial and ethnic backgrounds are essential to the future of the legal profession
To Promote Diversity in Law Schools and in the Legal Profession
The Law School Admission Council (LSAC) is committed to fostering diversity in law schools and the legal profession. Currently, through its Diversity Committee, LSAC sponsors and funds a number of initiatives aimed at increasing the diversity of the legal profession. These initiatives include organizing national and regional pipeline workshops that promote the development of outreach and early educational programs for students from diverse backgrounds; offering grants to support diversity initiatives at LSAC-member law schools; maintaining databases and websites such as DiscoverLaw.org with information, resources, and programs that encourage students of color, students living with a disability, and LGBTQ students to pursue a legal career and equip them with the tools for successful admission and graduation from law school; and engaging in ongoing collaborative programs and projects with prelaw advisors and students at Historically Black Colleges and Universities (HBCUs), Hispanic Association of Colleges and Universities (HACUs), and Tribal Colleges and Universities (TCUs). For decades, studies consistently have shown that students of color, students living with a disability, and LGBTQ students are underrepresented in most law schools. As a consequence, smaller percentages of persons who represent these groups are graduating from law school and entering the legal profession. This writing competition is designed to reinvigorate the dialogue about the recruitment and retention strategies that law schools should deploy to yield a more diverse class of graduates who will enter the legal profession.
Entry procedures Include a cover page with your submission. The cover should only contain the author's name, title of the paper, mailing address, law school affiliation, law school status (lL, 2L, 3L/4L), a telephone number where the author may easily be reached, and an email address.
To allow anonymous evaluations, please do not put your name on the actual paper. The title on the paper must precisely match the title on the cover page that contains the identifying information described above.
Email entries to DiversityOffice@LSAC.org. Only electronic files (PDF or Word) will be accepted.
Judging A panel of law school faculty, legal writing instructors, and LSAC diversity committee members will evaluate each submission and select the winning papers. If no paper meets the standards set forth in this announcement, the panel may decide either not to issue an award or publish a paper. The panel's decision will be final.
Deadline All papers must be sent no later than 5:00 PM EST on Friday, March 31, 2017. No extensions will be granted under any circumstances. Papers submitted after the deadline will not be eligible for an award. All submissions become the property of LSAC, and LSAC will retain the copyright of any winning papers selected for publication.

2017 Essay Question
An employer hired a driver to operate a delivery van. Before the employer allowed the driver to operate the van, the employer checked the driver's prior employers, required the driver to undergo a physical examination by a licensed doctor, and provided the driver with extensive training in car safety. Frank, the medical doctor who examined the driver, discovered that the driver had a sleeping disorder that caused the driver to randomly fall asleep and that the driver had on multiple occasions fallen asleep while driving. The driver pleaded with Frank not to tell the employer about the sleeping disorder. Frank agreed, and omitted this information from the driver's physical examination form that he sent to the employer. Frank also sent a letter to the employer assuring him that the driver was medically fit to be a delivery driver. The employer then provided the driver with a daily route and paid him a weekly salary. While the driver was making deliveries for the employer, the delivery van left the road and struck a pedestrian, who suffered severe injuries as a result. The pedestrian filed a lawsuit for the damages as a result of the serious injuries sustained in the car accident against the driver, the employer, and Frank the doctor.
- Can the pedestrian prevail under the doctrine of res ipsa loquitur concerning Driver's alleged negligence? Discuss.
- What arguments will the pedestrian make in support of his negligence claims, what defenses can be raised, and who is likely to win in a lawsuit filed by the pedestrian against: a. The employer? Discuss. b. Frank the doctor? Discuss.

Description:
YYC Employment Law Group is a Calgary-based employee-side boutique law firm dedicated to providing legal advice and representation to employees of any kind in any workplace-related legal issue.
At YYC Employment Law Group, we understand how important a strong legal education is to those who are interested in practicing employment law. We also understand how expensive getting a law degree can be. With that in mind, YYC Employment Law Group is offering a $2,500 CAD scholarship to a Canadian resident entering their third year of the JD program in the Faculty of Law.
Application Deadline: August 31, 2019

The $2,500 CAD scholarship is being offered to a law student who can demonstrate excellence in employment law and superior academic achievement in their journey to becoming an employment lawyer.
The practice of employment law, and particularly employee-side employment law, is crucial in today's non-unionized labour market. As advocates for the vulnerable and often marginalized, employee-side employment lawyers provide a necessary level of protection against the inequalities inherent in the master-servant relationship, workplace exploitation in various forms, and harassment, bullying and discrimination. We are admittedly biased, but we think it's one of the most important practice areas within the legal profession.
WHAT WE'RE LOOKING FOR: A written submission regarding the reasons underlying your passion for employment law and, specifically, why the protection of employees under the law is still necessary in 2019.
Applicants should submit a 1,000-word essay (maximum) surrounding a relevant employment law topic of their choosing (i.e. human rights, wrongful dismissal, etc.) and why strong legal advocacy is required for the continued protection of employees. Emphasis can be given to personal anecdotes, case law and/or academic and scholarly literature.

Application Process
- Submit an essay not to exceed 1,000 words to scholarship@yycemploymentlawgrp.com in either .doc or .pdf format.

- Your essay should showcase your passion for and understanding of employment law, as well as demonstrate excellent grammar.
- Once submitted, entries cannot be returned or edited and only one entry per applicant.
