SCC cites UAlberta Law professor in recent decision

Research by Prof. Mitchell McInnes cited in Atlantic Lottery Corp v Babstock

For the second time this summer, the Supreme Court of Canada has relied extensively on research by Professor Mitchell McInnes, an expert in unjust enrichment, restitution, and contracts at the University of Alberta Faculty of Law.

Atlantic Lottery Corp v Babstock 2020 SCC 19 dealt with the difference between restitution and disgorgement, as well as the availability of gain-based relief for breach of contract.

The Court cited Professor McInnes' text, The Canadian Law of Unjust Enrichment and Restitution, as well as a journal article, "Gain-Based Relief for Breach of Contract: Attorney General v Blake," which appeared in the Canadian Business Law Journal.
