SCC cites extensively from UAlberta Law expert in unjust enrichment in Uber appeal
Law Communications - 28 July 2020
Professor Mitchell McInnes' text, The Canadian Law of Unjust Enrichment and Restitution, was cited extensively by both the majority and the dissenting judges in Uber Technologies Inc v Heller 2020 SCC 16 <https://scc-csc.lexum.com/scc-csc/scc-csc/en/item/18406/index.do>. The appeal focused on the doctrine of unconscionability. The Court invalidated a contractual term that required aggrieved Uber drivers to proceed by arbitration in Amsterdam rather than litigation in a Canadian court.
