The Clinton J. Ford Moot is an in-house appellate moot for law students, with a problem on either a criminal or constitutional law topic. U of A Law Appellants were Mike Boultbee (3L) and Karen Wun (3L), and the U of A Law Respondents were Mimi Wang (3L) and Barbara Acton (2L). This year the case mooted was R v Hutchinson, (2010), 286 NSR (2d) 331, which considered whether consent to protected sexual intercourse extends to unprotected sex and whether sabotaging a condom is tantamount to fraud, which vitiates consent for the purposes of a sexual assault charge. The winning team of Michael Boultbee and Karen Wun narrowly defeated the able team of Mimi Wang and Barbara Acton. The mooters appeared before a bench comprised of Madam Justice Ross, Mr. Justice Gates, and Mr. Justice Brown from the Alberta Court of Queen's Bench.
The mooters and their coach Professor Matthew Lewans, expressed their thanks to all who helped with the moot, including Professors Sankoff, Penney, Adams, and Renke and Mr. Justice Slatter from the Alberta Court of Appeal for their expert guidance, as well as Stella Varvis, and Katherine Thompson for their assistance in organizing the competition.
"I was very impressed by our students' performance this year," commented coach Professor Matthew Lewans. " In particular, I was impressed by their willingness to seek out constructive criticism from their peers, professors, and volunteer judges and improve their written and oral submissions. The advocacy skills our students developed in the Clinton J. Ford Moot will continue to pay dividends when they graduate, and join the illustrious ranks of our practicing alumni."
